Please read these Terms of Service ("Terms") carefully before using the Service Scalers website or engaging our marketing services. By accessing our website or signing a service agreement, you agree to be bound by these Terms.

1. Services

Service Scalers provides digital marketing services for home service businesses, including but not limited to: pay-per-click advertising, local service ads management, search engine optimization, Google Business Profile management, Meta advertising, and website design.

Specific services, deliverables, pricing, and timelines are governed by individual service agreements or statements of work executed between Service Scalers and each client.

2. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate business information required to perform services.
  • Grant timely access to advertising accounts, website platforms, and analytics tools as needed.
  • Review and approve materials (ads, copy, landing pages) within agreed-upon timelines.
  • Make timely payments per your service agreement.
  • Notify us of material changes to your business, market, or service offerings.

3. Payment Terms

Payment terms, rates, and billing cycles are specified in your service agreement. Unless otherwise stated:

  • Management fees are billed monthly in advance.
  • Ad spend is billed separately and paid directly to ad platforms (Google, Meta, etc.) unless otherwise arranged.
  • Late payments may result in service suspension after 10 days.
  • All fees are non-refundable for work already performed.

4. Intellectual Property

Upon full payment, all creative assets, ad copy, and website content we develop for you become your property. We retain the right to use anonymized campaign data and aggregated performance metrics for benchmarking and case study purposes.

Service Scalers retains all rights to our proprietary processes, methodologies, templates, and internal tools.

5. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the engagement. This obligation survives termination of services for 2 years.

6. Performance & Results

We commit to applying our full expertise and best practices to your campaigns. However, we cannot guarantee specific results. Advertising performance depends on market conditions, competition, seasonality, your offers, and factors outside our control. We do guarantee transparency, regular reporting, and proactive optimization.

7. Cancellation & Termination

Either party may terminate services with 30 days written notice, unless a different notice period is specified in your service agreement. Upon termination:

  • All outstanding fees for work performed are due immediately.
  • We will provide account access and any assets we hold for your accounts within 5 business days.
  • Ad campaigns will be paused on the termination date.

8. Limitation of Liability

To the fullest extent permitted by law, Service Scalers's total liability for any claim arising from our services shall not exceed the total fees paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

9. Website Use

By using this website, you agree not to:

  • Use the site in any way that violates applicable laws.
  • Transmit spam, malware, or unauthorized solicitations.
  • Attempt to gain unauthorized access to our systems.
  • Reproduce or redistribute our content without written permission.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or our services will be resolved through binding arbitration.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after updates constitutes acceptance of the revised Terms. We will post the updated date at the top of this page.
